SECTION 21 - SMS MARKETING CONSENT
Program description and consent:
DAVION STORE offers a recurring SMS/text message marketing program (the "Program"). By checking the SMS marketing consent box at checkout and submitting your mobile phone number, you give your express written consent to receive recurring automated promotional marketing text messages from DAVION STORE at the number provided, including cart reminders, even if your mobile number is registered on any state or federal Do Not Call list.
Consent is not a condition of purchase. You may buy from us without joining the Program. The consent box is never pre-checked; you must actively select it. The checkout is our only SMS opt-in point. Message frequency varies. Message and data rates may apply.
Eligibility:
You must be at least 18 years old and the owner or authorized user of the mobile number you submit.
How to opt out:
Reply STOP to any mobile message sent by us, or use the unsubscribe link provided in any of our messages. After you send STOP, we will send you one final message confirming that you have been unsubscribed. You understand and agree that alternative methods of opting out, such as using other words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider.

Carriers and delivery:
The Program is available on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. To the extent permitted by applicable law, you agree that we will not be liable for any failed, delayed, or misdirected delivery of any information sent through the service.
Privacy:
We do not sell your personal information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Your mobile number is shared only with our SMS delivery provider and the mobile carriers, strictly to transmit the messages you requested. SECTION 22 - CLASS ACTION WAIVER AND ARBITRATION AGREEMENT
You agree that any dispute shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association.
Opting out of arbitration: You may opt out within 30 days from the date you first purchase any product or service by sending written notice to: DAVION STORE, 1908 Thomes Ave STE 69016, Cheyenne, WY 82001, United States. Your notice must include (1) your name, (2) your address, and (3) a clear statement that you do not wish to resolve disputes through arbitration.
Class Action Waiver: You may only bring Claims in your individual capacity, not as a class member in any purported class proceeding.
Note: The arbitration and class action waiver provisions in this Section do not apply to claims brought under the Telephone Consumer Protection Act (TCPA) to the extent such application would be prohibited by applicable law.
